The Department is constituted under the Government Departments Act, 1987, and its primary functions are set in the Industry Board Act, 1981 and various Merchant Shipping Acts. In addition, the Department is granted authority to act by a wide range of primary and secondary legislation, Tynwald approved schemes and policy documentation. A list of the Department's main sources of authority to act is as follows:
